1. How to Enter: Sweepstakes begins 12:00:01 A.M. ET on September 29, 2004, and ends at 11:59:59 P.M. ET on November 30, 2004. There are two ways to enter the SNK Sweepstakes. 1) Internet: You may enter online by visiting www.snksweeps.com and completing the sweepstakes entry form as prompted. Normal Internet access and usage charges imposed by your on-line service will apply. Online Entries must be received by 11:59:59 PM ET on November 30, 2004. 2) Mail-In: You may also enter by hand printing your name, complete address, zip code, date of birth and home phone number on a plain 3” x 5” piece of paper and mailing it in a hand-addressed, stamped envelope, to: “SNK Sweepstakes”, P.O. Box 7910 Melville, NY 11775-7910. All mail-in entries must be mailed separately, and must be postmarked by November 30, 2004, and received by December 7, 2004, to be included in the random drawing. Entries must be complete to be eligible. Mechanically reproduced or photocopied mailed entries will not be accepted.

2. Random Drawing: Winners will be randomly selected on or about December 10, 2004, from among all eligible entries received. Drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions will be final on all matters relating to this sweepstakes. Odds of winning will be dependent upon the number of eligible entries received. All prizes will be awarded and winners will be notified by mail. Prizes are nontransferable and no substitutions are allowed except by the Sponsor who reserves the right to award a prize of equal or greater value if advertised prize is unavailable. Sponsor and its agencies assume no responsibility or liability for damages, losses or injury resulting from acceptance or use of any prize.

3. Prizes and Approximate Retail Values (“ARV”): Grand Prize (1): An SVC Arcade Unit; The ARV of the Grand Prize is $5,000. First Prizes (20): An Xbox gaming system, an Xbox live one year subscription, a Gamefly trial subscription and a copy of the SVC game; The ARV of each First Prize is $272. Second Prizes (30): A Gamefly trial subscription; The ARV of each Second Prize is $22. The ARV of all prizes is $11,100.


4. Eligibility: This Sweepstakes is open to legal residents of the Continental United States (excluding RI and FL) and Canada (excluding Quebec), who are 13 years of age or older, as of September 29, 2004. Employees of DC Comics, SNK NeoGeo, their advertisers, participating retailers and prize providers, and each of their respective subsidiaries, affiliates, parent companies, distributors, divisions, agencies, Don Jagoda Associates, Inc., and their immediate families (parents, children, siblings, spouse) and members of their same households (whether related or not) are not eligible to participate in this sweepstakes. This offer is void wherever prohibited or restricted by national, state, municipal, provincial or any other government laws. Subject to all federal, state, local, municipal and provincial laws.

5. General Rules: This sweepstakes will be governed by the internal laws of the State of New York. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the state of New York in the United States. No responsibility is assumed by Sponsor or prize providers for lost, late, illegible, mutilated, mistranscribed or postage-due mail or for technical, hardware or software malfunctions, telephone failures of any kind, or unavailable network connections, failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this sweepstakes which may limit the ability to participate or by any human error which may occur in the processing of the entries in this sweepstakes. Online entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right to cancel the online portion of the promotion if it becomes technically corrupted, and award prizes from eligible online entries received prior to cancellation and all eligible mailed entries received. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor and its agencies assume no responsibility or liability for damages, losses, or injury resulting form acceptance or use of any prize. Potential Grand Prize winner (or parent/legal guardian if winner is a minor) will be required to execute and return an Affidavit of Eligibility, Liability/Publicity Release, where legal (or a Declaration of Compliance with Official rules for Canadian residents), within 10 days (20 days for Canadian residents) of attempted notification, or the prize will be forfeited and an alternate winner will be selected. If any potential winner is a minor in his/her state/province of residence, prize will be awarded in the name of parent or legal guardian, who, where applicable, must execute Eligibility documents on behalf of minor. Return of any prize/prize notification as undeliverable will result in disqualification and alternate selection. If winner is a Canadian Resident, he/she must answer unaided an arithmetic skill-testing question as a condition to winning a prize. Acceptance of prize constitutes permission to the Sponsor and its agencies to use the winners’ names, hometowns, and/or likenesses for promotional purposes without further compensation, unless prohibited by law. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges.

6. General Release: By entering the Sweepstakes, you (and, if you are a minor, your parent or legal guardian) release Sponsor, participating prize providers and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or delivery, mis-delivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN FURTHER AGREES TO INDEMNIFY EACH OF THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES DESCRIBED IN THIS PARAGRAPH WHICH MAY BE SUFFERED BY YOU.
